Terms of Service
What we provide, what we don't control, and the rules that govern your use of the Service.
Copyright & intellectual property
1.1 All content, graphics, designs, structure, digital media, and any other matters related to PanicVPN are protected under applicable copyrights, trademarks, intellectual property rights, and other proprietary rights of the Operator.
1.2 Copying, redistribution, reverse engineering, or publication of any part of the Service is strictly prohibited without the prior written consent of PanicVPN.
1.3 Use of the Service does not transfer to the User any ownership rights in materials, source code, brand assets, or designs of PanicVPN.
Account & access
2.1 A registered account is required to access most features of the Service. The User is solely responsible for the security of their credentials and for any actions performed via their account.
2.2 The right to use the Service is personal and non-transferable. Sharing account access, selling accounts, or transferring active Subscriptions to third parties is prohibited and may result in immediate account termination.
2.3 Holding a paid Subscription does not grant unlimited rights over the account. The Operator may restrict or terminate access in cases of abuse, fraud, or violation of these Terms.
Ordering & delivery
3.1 To place an order for a Subscription, the User must be a registered account holder in good standing.
3.2 Services are not provisioned until payment has been confirmed by the payment provider. Subscription duration and expiration are calculated from the moment payment is confirmed.
3.3 Chargebacks, payment disputes, or fraud signals will result in immediate suspension of the Subscription, and the account may be permanently terminated depending on the outcome of the investigation.
Pricing
4.1 All prices, tariffs, limits, and locations are subject to change at any time without prior notice. The current pricing is published on the Service website.
4.2 Orders placed and fully paid before a pricing change retain the originally agreed price for the remaining paid period. Any subsequent renewal is billed at the price effective at the time of renewal.
Refunds & Balance
5.1 The Service does not offer refunds for purchased Subscriptions, top-ups, or any in-Service operations, including cases of unused remaining time.
5.2 The internal Balance is a conditional accounting unit used solely for Subscription billing within the Service and is not a monetary obligation of the Operator in the sense of civil turnover.
5.3 The Operator may, at its sole discretion, issue a partial credit to the User's Balance as compensation for prolonged technical incidents that materially affected service availability. Such compensation is voluntary and does not constitute an admission of liability.
Service availability
6.1 The Operator endeavours to keep the Service available 24/7 but does not guarantee uninterrupted operation. The Service may be temporarily unavailable due to maintenance, network conditions, third-party outages, or other circumstances beyond the Operator's control.
6.2 Access may be suspended, with or without notice, for emergency maintenance, security incidents, infrastructure migration, or other operational reasons.
6.3 Performance metrics shown on the Service website (speed, latency, uptime) are expected targets and are not contractual guarantees.
Acceptable use
7.1 Transmission of torrent and other P2P traffic through the Service is prohibited. The restriction is enforced by traffic-signature analysis at network level, without inspecting payload or correlating with Accounts. Violations may result in throttling, access restriction, or termination without refund.
7.2 Reselling Subscriptions, API access, or any part of the Service to third parties without explicit written permission from the Operator is prohibited, as it materially affects the commercial integrity of the Service.
7.3 Beyond the restrictions explicitly listed in §7.1–§7.2 and the conduct rules in §9, the Service does not classify, inspect, moderate, or evaluate the legality of the User's traffic. The User independently determines the purpose and nature of their network activity.
7.4 The Service is a technical tool of encryption and traffic routing and is not a party to the User's communications. The User has full freedom of action in the network. Any actions of the User — lawful or unlawful from the standpoint of any jurisdiction — are the User's personal matter and personal responsibility. By virtue of the zero-log architecture (see Privacy Policy §3), the Operator has no knowledge of such actions and is not liable for them. The only exception is acts directly aimed at the Operator, the Service infrastructure, its staff, or its commercial integrity (see §7.1, §7.2, §9).
Disclaimer
8.1 The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Operator makes no warranty as to the accuracy, completeness, fitness for a particular purpose, or non-infringement of any materials on the Service website.
8.2 The Operator may change information, products, prices, available locations, and other Service parameters at any time without prior notice.
8.3 To the maximum extent permitted by applicable law, the Operator's total aggregate liability does not exceed the amount actually paid by the User under the current Subscription for the month in which the ground for liability arose.
Conduct toward the Service
Scope of this section. This section addresses only actions directly affecting the Operator, the Service infrastructure, its staff, or its commercial integrity. It does not regulate the User's activity in the network outside of the Service — see §7.3 and §7.4 and the Privacy Policy.
- Insulting or harassing the staff, administrators, or support representatives of PanicVPN is grounds for account termination.
- Any attempt to cause downtime, degrade, or compromise PanicVPN systems, including DDoS against the Operator's own infrastructure, exploitation of vulnerabilities of the Service, or unauthorised access to internal systems, is grounds for permanent termination.
- Sharing account credentials with other persons, operating multiple accounts to circumvent technical limits, or transferring an active Subscription to a third party is prohibited.
- Initiating chargebacks or payment disputes in bad faith, or providing false payment information, is grounds for immediate suspension and may lead to permanent termination depending on the outcome of the investigation.
- The Operator may apply sanctions ranging from a warning to permanent termination, in proportion to the violation, and is not obliged to disclose specific reasoning when enforcing these Terms.
Changes & contacts
The Operator may amend these Terms at any time by publishing a new version on the Service website. Continued use of the Service after publication of a new version constitutes acceptance of the updated Terms by the User.
